Terms of Service

These terms govern your use of gizmocart.co.za and any purchase made through it. By placing an order, you agree to these terms and to South African consumer protection law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

1. Who we are

GizmoCart (Pty) Ltd, trading as GizmoCart, registered in South Africa (Reg. No. [to be inserted]). Registered address: Midrand, Gauteng, South Africa. Contact: hello@gizmocart.co.za.

2. Products and fulfilment

Some products are shipped directly from our Midrand facility ("in-stock"), and some are shipped on our behalf by third-party fulfilment partners ("dropship"). Where an item is dropshipped, delivery timeframes may differ slightly (typically 2-3 business days) from in-stock items (same-day dispatch). This is disclosed on every product page.

3. Pricing

All prices are listed in South African Rand (ZAR) and include VAT where applicable. We reserve the right to correct pricing errors before an order is confirmed. Prices may change without notice; the price at checkout is the price you pay.

4. Payment

Payments are processed securely by Paystack. We do not store your card details. Your order is only confirmed once payment has been successfully verified.

5. Your right to cancel (cooling-off period)

Under section 44 of ECTA, you may cancel an order placed online within 7 days of receiving the goods, without reason or penalty, except that you are responsible for the direct cost of returning the goods. This does not apply to goods made to your specification or that have been opened and cannot be resold for hygiene reasons (see our Returns & Refunds Policy).

6. Delivery

We aim to deliver within the timeframes stated at checkout. Risk in the goods passes to you on delivery. See our Shipping Policy for full detail.

7. Product safety

We only list toys that meet South African and international toy safety standards (SANS 8124 / ISO 8124) appropriate for their stated age range. Always follow the age recommendation and supervision guidance printed on the product packaging.

8. Limitation of liability

To the extent permitted by law, GizmoCart's liability for any claim arising from your use of this site or purchase of goods is limited to the value of the relevant order. Nothing in these terms limits any right you have under the CPA that cannot lawfully be excluded.

9. Governing law

These terms are governed by the laws of the Republic of South Africa. Disputes that cannot be resolved directly may be referred to the National Consumer Commission or the relevant Consumer Goods and Services Ombud.

10. Changes to these terms

We may update these terms from time to time. The version in effect at the time of your order applies to that order.
